General.

These terms and conditions and any contract between us shall be governed by and construed in accordance with English Law and the English Courts shall have jurisdiction over any disputes between Treasured Memories Slideshow Services Ltd and the customer.
From Time to Time the Terms, Conditions and Prices may change. 

Payment.

Prices stated are VAT Free, as we are not a VAT registered company.  Orders will be invoiced at the current prices at the time of ordering.  Normally your Cheque or Postal Order must be received at our premises prior to work commencing.

Delivery.

Our aim is to complete your order within 10 to 15 days of receipt, this may change dependant on the current workload and seasonal variations.  If we have any delays we will inform you of them and give you an expected completion date.

Guarantee.

All DVD’s including copies are viewed prior to dispatch to ensure perfect quality.  If for any reason there is a technical fault with your DVD or we did not carry out your instructions properly we will replace it and any copies free of charge. We can not be held responsible for damaged or mishandled discs.  We do not provide refunds once the DVD has been posted to you, we will replace or correct any technical fault or where we have not carried out your instructions properly. 

Your DVD Player.

Your DVD should be compatible with DVD-R or DVD+R technology.  Most DVDs that have been purchased within the last three to four years should be compatible.  In the event you are unable to play the DVD on your player, please contact us within 7 days of delivery and we will attempt to write a disc that is compatible.  We can not be held responsible for damaged or mishandled discs.  See our FAQ's  Page for more details.

Your Responsibility.

We accept your order on the basis that you own the copyright and intellectual reights to the work, you must ensure that the material supplied:

1.  Doe's not contain obscene material.

2.  Doe’s not infringe on any third party’s copyright, patent, trade secret or trademark or any other proprietary rights

3.  Complies with current laws on audio and visual material. 

Notwithstanding point 2. above, in the event that we were to incur any liability, demand, damages or costs from any third party in relation to intellectual property rights infringement, you will fully indemnify and hold us harmless in respect of such liablility demands for damages or costs.

Numbering & View from Side.

It is the customers responsibility to ensure that we can identify the view from side of each slide, if the view from side is not identified we will try to identify it from the image or from similar slides.  Treasured Memories will not rescan images that were not clearly marked.  If you want your slides in order you must number them for us, if slides are not numbered we will make every attempt to keep them in the order they are in on receipt, however Treasured Memories  will not rescan images that were not clearly numbered. Slide Mounts should be in good order, if for any reason the Slide Mount is damaged, we will attempt to scan the slide, we can not be held responsible for any damage that may occur in this process.

Loss or Damage to Your Material.

Treasured Memories  Do not accept responsibility for loss or damage to your photographs, Images or other Materials whilst in the hands of a postal service. In the unlikely event of loss or damage after receipt, we will refund the replacement value of the original materials to a maximum of £10. Requesting Treasured-Memories Slideshow Services to provide a service, you implicitly agree to consent to this Policy..

We recommend that you use Recorded or Special Delivery to send us your material.

Please mark your packages FRAGILE, PHOTOGRAPHS, DO NOT BEND.

We Reserve the Right to Refuse Work .

Treasured Memories  Reserve the right to refuse work that involves images that may already be copyrighted material, or for any other reason, specified or otherwise, at our discretion. 

Data Protection

All data supplied to Treasured Memories  and held electronically is only held in order to return your photographs and produce receipts and accounts and to follow up on prospective customers who have requested a quote or a Sample DVD.  We usually e-mail prospective customers who have requested a Sample DVD, as a courtesy follow up, we will never contact you more than once.   

Treasured Memories  will never release your information to any third party.  After follow up, all information will be deleted.

Copyright

Any images or copies of images whether stored digitally or otherwise are protected by the Copyright and Design Act 1988.   It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the Owner. 

You the customer will always remain the copyright owner of the original image.
